filter blocks saving as draft only, not able to publish

I was told to create a support ticket and it wont let me until i make a post.

i am trying create additional filter blocks and have made 3 so far. all three of them save as either draft or pending review only. the publish function is not even an option. what is wrong with my plugin? do i have to upgrade to get the publish function?
